Constitutional Crisis in Poland: People Take to Streets at Midnight Over Tribunal Chief’s Suspension, Accused of 'Coup', President Nawrocki Cuts Foreign Visit Short

A fresh political upheaval has erupted in Poland. Anti-riot police have been deployed amidst protests against the suspension of Constitutional Tribunal Chief Bogdan Święczkowski. This confrontation has further intensified the power struggle over judicial control between Prime Minister Donald Tusk’s government and the opposition Law and Justice (PiS) party.

What Happened at Midnight?

The Tribunal building was heavily guarded by police as demonstrators protested Święczkowski's suspension.

Tension escalated when protesters breached the court's perimeter and allegedly hurled objects at police officers.

Police detained three individuals.

PiS-backed President Karol Nawrocki cut short his visit to Senegal and returned to Warsaw. He wrote on X, "At such a time, the President must be in Poland." His Chief of Staff confirmed that he visited the Tribunal campus.

What is the Root of the Dispute?

Justice Minister Waldemar Żurek sought to lift the legal immunity of Święczkowski and Vice-President Bartłomiej Sochański to initiate criminal proceedings against them. They are accused of preventing 5 newly elected judges from participating in Tribunal proceedings. Defending its leadership, the Tribunal stated that both appointments were legally valid and labeled the government's move a "coup."

Why Has the Judiciary Become a Political Arena?

The PiS government, in power from 2015 to 2023, had implemented judicial reforms.

Critics, including European institutions, argued these reforms undermined judicial independence and increased political influence over the courts.

The European Court of Human Rights and the EU Court of Justice had also expressed concern over judge appointments in the Tribunal.

Tusk, who took office in 2023, had pledged to roll back these reforms, but President Nawrocki and former President Andrzej Duda, both aligned with the opposition camp, are fiercely resisting them.

Arguments from Both Sides

Tusk Government: Strict measures were necessary to restore the rule of law.

PiS Leaders: They strongly condemned the move and called on citizens to protest.

With parliamentary elections scheduled for next year, this standoff has raised fresh questions regarding constitutional rights, judicial independence, and the boundaries of executive power.
